General terms and conditions of sale

This document (General Terms and Conditions of Sale) defines the conditions applicable to sales concluded between, on the one hand, persons making a purchase via the Jonak website, hereinafter referred to as ‘Customers’ and, on the other hand, the company KILMA JONAK, hereinafter referred to as ‘JONAK’.

1. Validity of the T&Cs and scope of application


1.1 These conditions apply exclusively to non-trading individuals.  
 
These conditions apply to the exclusion of all other conditions, in particular those in force for in-store sales. 
 
These general terms and conditions of sale apply exclusively to non-trading individuals aged 18 or over. 
 
1.2 The ‘customer’ is understood to be any natural person who is acting for purposes that do not fall within the scope of their trade, business, craft or profession who is at least 18 years of age and has ordered at least once from the website. 
 
Customer accounts may only be created by natural persons aged 18 or over.  
 
1.3 The T&Cs applicable to a customer’s order for an item are those in force on the day of the order. 
 

1.4 If any of the provisions of these general terms and conditions of sale are declared invalid in whole or in part, the other provisions and other rights and obligations arising from these general terms and conditions of sale shall remain unaffected and shall continue to apply. 

These conditions apply to the exclusion of all other conditions, in particular those in force for in-store sales. 


 

2. JONAK products


2.1 Each JONAK product is presented on its own page. JONAK endeavours to represent the characteristics of the products as accurately as possible. 

2.2 Before placing your order, please study the product description and characteristics carefully.

3. Item prices

 
3.1 All item prices are quoted in euros (€), inclusive of all taxes, and do not include shipping and handling costs (see Shipping and Delivery paragraph) or any additional costs. 
 
These additional charges will be added to the order summary page before final validation and will also appear on the Order confirmation page. 
 
3.2 Items will be invoiced on the basis of the prices in force at the time the order is placed. They remain the property of JONAK until full payment has been received.  
 
3.3 This price is payable in full in a single instalment. 

3.4 Any order placed on the website and delivered outside France may be subject to possible taxes and customs duties which are imposed when the parcel reaches its destination. 
 
These customs duties and any taxes associated with the delivery of an item are the customer’s responsibility. JONAK is not obliged to check and inform its customers of applicable customs duties and taxes.  
 
3.5 JONAK products may be subject to spontaneous promotions. The duration of the promotion will be specified on the home page of the www.jonak.fr website.

 

4. Ordering


Customers can place orders on the www.jonak.fr website.

4.1 Order process

Orders are placed and received solely via the Internet and processed by JONAK. 
  • To place an order, the customer must select the product(s), add them to the virtual basket, indicating the quantities required, and click on the ‘Add to basket’ button.   

The Customer must go to the ‘Basket’ page and, once they have checked the contents of the basket, click on the ‘Confirm my order’ button.  
 
Customers must then enter their e-mail address to log in, create an account or continue as a guest. 
 
If the Customer has an account, they must fill in the ‘password’ field and then click on the ‘log in’ button.  
 
If the Customer does not have an account, they must respond to JONAK’s suggestions to receive promotional offers by e-mail and SMS, then click on the ‘order now’ button.  
 
The Customer must then fill in the ‘your address’ field by selecting from the categories suggested (‘home’, ‘office’, ‘friend’s house’, ‘other’).  
 
The Customer must then enter their details: surname, first name, date of birth and phone number and click on the ‘confirm’ button.  

JONAK is not responsible for the authenticity or accuracy of the information provided by the Customer.

JONAK cannot be held responsible for any errors in the contact details provided by the Customer.
  • The Customer must choose one of the delivery methods offered. 
 
Before clicking on the ‘Confirm’ button, Customers may check the details of their Order and its total price and return to the previous pages to correct any errors or make any changes to their Order. 
  • The Customer must select one of the payment methods offered and provide the necessary information.  
 
Confirming the Order implies the acceptance of the T&Cs and the contract with JONAK. 
 
Any order implies acceptance of the prices and descriptions of the items as described on the website that are available for sale. 
  • An e-mail confirming the Order will be sent by JONAK to the Customer, with a summary of the Order. 

JONAK reserves ownership of the items until full payment of the order, i.e. collection of the order price by JONAK. 

4.2 Changes to the order after confirmation  
 
Any change to information sent during the ordering process after confirmation of the order is subject to acceptance by JONAK, which will use its best efforts to check whether the change is feasible and the possible additional costs.


4.3 Order validation
 
JONAK reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes. 
 
JONAK reserves the right to refuse any order for legitimate reasons and, more specifically, if the quantities of products ordered are unavailable or abnormally high for buyers who are consumers. 
 
JONAK undertakes to honour orders received on the website only within the limits of available stocks.  
 
If one or more items ordered are not available, JONAK will inform the customer as soon as possible and, if necessary, reimburse the customer within 14 days of payment. The customer’s order will then be automatically cancelled.  

 

5. Shipping and Delivery


5.1 Delivery is provided by JONAK in Mainland France and Belgium. 

Customers can choose from the following three delivery methods:  
  • Home delivery (Delivery between 2–4 working days)
  • Delivery to a Mondial Relay collection point (no obligation to purchase from the selected retailer) – (Delivery between 3–4 working days) 
  • Delivery by Chronopost for France (24-hour delivery)  

5.2 Due to numerous fraud attempts, JONAK has strengthened the security and tracking of deliveries.

Products are shipped to the delivery address indicated by the customer when they place their order, in accordance with the conditions formulated by the customer. 

It is the customer’s responsibility to provide all the specifications required for smooth delivery: full address, floor, door, letterbox, person authorised to receive the parcel, etc. 

Any lack of information required will exonerate JONAK in the event of delivery difficulties. 
 
5.3 Excluding sales periods, any order placed on the JONAK website before 7 a.m. Monday to Friday (excluding public holidays) will be prepared by our warehouse the same day, subject to validation of payment. 

The average time taken to receive an order for delivery to an address in mainland France is 3 working days from the order date. 

JONAK undertakes to make every effort to deliver the items ordered and paid for by the customer within the agreed delivery times.  

Delays may nevertheless occur in the event of unforeseen circumstances or for reasons relating to the place of delivery.
 
5.4 If the said items have not been delivered within 7 working days of the delivery date stipulated when the order was placed, and if this delay is not due to a case of force majeure or an event falling within the remit of the delivery service provider (particularly in the case of an option for delivery to a collection point), the customer may cancel the sale by sending an e-mail to the following address: sav@jonak.fr

The sums paid by the customer will be reimbursed. 

5.5 JONAK provides its customers with order preparation and delivery tracking.

The items ordered will be deemed to have been delivered and received by the Customer as soon as delivery is confirmed by the carrier or the collection point confirms that the Customer has collected the parcel. 

In these two cases, no order refund will be made by JONAK. Your parcel will only be delivered by the carrier on presentation of your ID and with your signature. Consequently, the carrier’s tracking is proof of your receipt.

Otherwise, JONAK reserves the right to assess the veracity of the delivery issue before proceeding with the reimbursement. Postage costs will be deducted from the total amount of the refund. 
 
5.6 On receipt of the order, the Customer must check that the products received conform to the order. 
 
Any item defects (damage, missing item compared to the order form, damaged or opened parcel, broken or defective item, etc.) must imperatively be notified to JONAK, by phone or e-mail at sav@jonak.fr or directly via the contact form on the ‘Contact us’ page.

Any claim submitted more than 72 hours after the delivery date will be rejected and JONAK will be released from any liability. 
 
5.7 If the aforementioned conditions for a claim are met, and the product defect is established, JONAK will refund the defective product(s).
The customer may also place another order and JONAK will then reship the missing product (subject to the customer’s request having grounds). 
 
All items supplied by JONAK are subject to the legal guarantee provided by Articles 1641 et seq. of the French Civil Code. (See Guarantee section) 

 

6. Payment


6.1 Origin of payment 

Mainland France 

The Customer may choose to pay for purchases:
 
  • by credit/debit card: Visa, MasterCard, Carte Bleue, issued in France, American Express
  • by Paypal, Apple Pay
  • by Gift Card
  • in instalments using: ALMA 
 
International 

The Customer may choose to pay for purchases:
 
  • by credit/debit card: Visa, MasterCard, Carte Bleue, American Express
  • by Paypal 

6.2 Payment validation

Payment is validated on receipt of the additional information requested when paying by credit/debit card requiring additional checks (See section on combating card fraud).  
 
Payment of the Order by the Customer is irrevocable, subject to a right of withdrawal, and constitutes the conclusion of the sales contract with JONAK. 

Once payment has been made and the order has been finally validated, an e-mail confirming the order, indicating the products ordered and a possible delivery date, will be sent to the Customer. 

The order will only be considered final once JONAK has sent the confirmation e-mail, and the sale of the product(s) will only be confirmed once the corresponding price has been paid. 

If the products are delivered without payment, JONAK reserves the right to claim ownership of the product(s) delivered. 

 

7. Secure transactions


JONAK makes every effort to ensure the confidentiality and security of data transmitted over the Internet and on the http://www.Jonak.fr website.

In this respect, the JONAK website uses a secure SSL (Secure Socket Layer) payment module.  

However, JONAK shall not be held liable in the event of any unforeseeable and insurmountable inconvenience, damage or difficulty inherent in the use of the Internet network, in particular a service interruption, external intrusion or the presence of computer viruses.

 

8. Promotions


JONAK may occasionally offer ‘promo codes’ to reduce the price of certain products or delivery services.  

It is the customer’s responsibility to enter the promo code when placing an order on the payment page.   

Each promo code has its own conditions which are indicated by JONAK in the code’s presentation (either on the website or by e-mail).  

The promo code cannot be combined with other ongoing promotions, except where specified by JONAK.  

The promo code may be limited to a specific part of the products sold on the website.  

If a promo code is not used properly (abuse or technical problem) JONAK reserves the right to cancel, modify or suspend it, without affecting orders already confirmed by JONAK. 

 

9. Combating card fraud


JONAK reserves the right to verify the personal data provided by the customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the person who placed the order, in order to avoid any fraudulent payments.

This verification may take the form of a request for proof of identity and/or address and/or bank documents (bank details or cancelled cheque).

If the customer does not respond to a request of this type within 2 days of the request made by JONAK, the order in question will be automatically cancelled, without any possibility of subsequent claims. 

JONAK will also be free to cancel any order that presents one or more risk factors for fraudulent card use.  

 

10. Right of withdrawal


In accordance with current legislation (Article L221-18 of the French Consumer Code), the customer has the right to withdraw from the contract within 14 days of its conclusion, without having to give any reason or pay any penalties.  
 
Any Customer who wishes to withdraw from an order placed on the JONAK website must therefore send the form below filled in within 14 days of receipt of the order to the following e-mail address: sav@jonak.fr

The Customer must follow the process for returning JONAK products as defined below to obtain a refund for their order. 

11. Returns and refunds


11.1 Time limit for returning an item 
In accordance with current legislation (Article L121-20 of the French Consumer Code), the customer has a period of 14 clear days to return a product ordered remotely from the date of receipt of the product indicated by the carrier.

11.2 Conditions for returning an item

11.2.1 Condition of the item(s)
The item(s) returned must be perfectly intact, new and unused.

They must be returned in their original undamaged box with all their accessories (original packaging, accessories, instructions, etc.) 

Without the original packaging, it will not be possible for JONAK to identify the references of the returned product and to reinstate it in stock. 

The product may also be damaged in transit. 

It is therefore essential to return it in the original box to ensure you receive a refund. 

On receipt of the parcel, JONAK will decide whether the goods returned are in perfect condition. No returns will be accepted if the items returned have been visibly used or damaged by the customer and this use or damage renders the items unfit for sale. 

11.2.2 Proof of return
The customer must keep the proof of deposit of the parcel for return which will be given to him by the carrier.

If the parcel is lost, no refund can be made by JONAK without this proof of deposit. 

The customer has a period of 15 working days from the date of deposit of the return package to make any claim relating to its return. 
No requests will be accepted after this deadline. 

The customer must send their claim directly via the contact form on the ‘Contact us’ page.

11.2.3 Return costs

From 11th December 2023, returning products to a collection point is not free using the return label that can be downloaded from the Customer Account. Indeed, returns cost €1.95 per label, which will be deducted from the amount refunded.

Returns are free in JONAK shops.By making the return to your nearest shop, you are helping to reduce the CO2 emissions produced by transportation

Please note that if your return is the result of an error on our part, such as a logistical problem, you will not be asked to pay the return shipping costs.

11.2.4 Refunds for returns
JONAK will issue a refund provided that all return conditions are met by the Customer within 14 days of receipt of the returned product(s) at our warehouse and reinstatement of the goods in stock. 

Delivery costs will be reimbursed if the right of withdrawal is exercised within the legal period and in compliance with the return conditions set out above. 

JONAK reserves the right to refuse a refund if attempted fraud is suspected.

 

12. Liability


12.1 JONAK is automatically liable to the customer for the proper execution of the contract concluded with the customer. 

However, JONAK cannot be held liable for the non-execution or poor execution of the contract concluded in the event of force majeure, the occurrence of an event attributable to the customer or any unforeseeable or insurmountable inconvenience or damage inherent in the use of the Internet network, in particular a service interruption, external intrusion or the presence of computer viruses.  

12.2 JONAK cannot be held liable for any difficulties encountered during the transport and delivery of the products. 

If the parcel is lost or damaged, or delivery is incomplete, the Customer is invited to contact the chosen carrier.

In accordance with the conditions set out in Article 5.5, as soon as the carrier confirms delivery of the order, JONAK considers that the Customer is in possession of the products. 

12.3 The JONAK website contains hyperlinks to other websites. JONAK cannot be held liable for the content of these websites if they contravene the legal and regulatory provisions in force. 

 

13. Legal guarantee


13.1 All items supplied by JONAK are subject to the legal guarantee provided by Articles 1641 et seq. of the French Civil Code. 
 
13.2 The customer has a period of 3 days from receipt of the items to make any reservations or claims for nonconformity or apparent defects in the items delivered, by e-mail to sav@jonak.fr, via the contact form; or by registered post with acknowledgement of receipt to the following address: Jonak, Customer Service, 13 rue Poissonnière 75002 Paris. 
 
After this period and if this procedure is not followed, the items will be deemed to comply and be free of any apparent defects, and no claims will be validly accepted by JONAK. 
 
13.3 If the apparent defect or nonconformity of the item is proven, JONAK undertakes to reimburse the customer as soon as possible.
 
This refund will be made within a maximum of 15 days. 
 
13.4 JONAK cannot be held liable for the misuse and/or intensive use of the items by the customer.  


In accordance with current legislation:  
 
Consumers have a period of two years from the date of delivery of the goods in which to invoke the legal guarantee of conformity in the event of non-conformity. During this period, the customer is only required to establish the existence of the nonconformity and not the date of its appearance.

The legal guarantee of conformity entitles customers to repair or replacement of the goods within thirty days of their request, free of charge and without any major inconvenience to them. 
 
If the goods are repaired under the legal conformity guarantee, the customer benefits from a six-month extension to the initial guarantee. 
 
If the customer asks for the good to be repaired, but the seller requires it to be replaced, the legal guarantee of conformity is renewed for a period of two years from the date on which the good is replaced. 
 
The customer can obtain a reduction in the purchase price by keeping the goods or terminate the contract and obtain a full refund in exchange for the return of the goods,
IF: 

7° The professional refuses to repair or replace the goods;
2° The goods are repaired or replaced after a period of thirty days;
3° The repair or replacement of the goods causes a major inconvenience for the customer, in particular when the customer definitively bears the cost of taking back or removing the nonconforming goods, or if they bear the cost of installing the repaired or replacement goods;
14° The nonconformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity. 
 
The customer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious as to justify an immediate reduction in the price or termination of the contract. In this case, the customer is not obliged to ask for the goods to be repaired or replaced beforehand. 
 
Customers do not have the right to rescind the sale if the nonconformity is minor. 
 
Any period during which the goods are immobilised with a view to their repair or replacement suspends the guarantee that was in force until the delivery of the repaired goods. 
 
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code. 
 
The customer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles you to a price reduction if the goods are kept or to a full refund in return for the goods.

15. Intellectual property


All texts, illustrations and images reproduced on the JONAK website are the property of JONAK under copyright law, for the whole world.  

For this reason, and in accordance with the provisions of the Intellectual Property Code, any total or partial reproduction of the JONAK website, its brands or the content published on the JONAK website, other than for your personal use and for non-commercial purposes, is strictly prohibited. 

 

16. Médiation


As part of its commitment to customer satisfaction, JONAK recognises the importance of a transparent and harmonious relationship with its consumers.
 
In order to reinforce this process, and in accordance with articles L612-1 to L612-3 of the French Consumer Code, JONAK is committed to informing its customers of the possibility of having recourse to mediation in the event of a conflict. Mediation may be requested for any dispute related to an order placed on the www.jonak.fr website.
In the event of a disagreement, and if no amicable solution has been found, the consumer has the possibility of having recourse free of charge to a consumer mediator.  

 

17. Settlement of disputes

 
17.1 These online terms and conditions of sale are governed by French law.
The language of these general terms and conditions of sale is French. 
 
17.2 In the event of any difficulty arising in connection with the order or delivery of JONAK products, you are invited to refer the matter to the mediation services. 
 
If no amicable solution is found, the French courts will have jurisdiction over the dispute.
